Terms & Conditions

This document contains the General Terms and Conditions of the Purchase and Sale Agreement between "Venom" EOOD, UIC 205389422, with its registered office and management address in the city of Plovdiv, Trakia district, bl. 193, entrance B, floor 6, hereinafter referred to for brevity Evolution Watches, on the one hand, and the person who has agreed to these General Terms and Conditions, hereinafter referred to for brevity Customer, on the other hand, in connection with the application and purchase of the offered through Evolution Watches – electronic goods store.

Definitions

In interpreting and applying these General Terms and Conditions, the terms and expressions specified below have the following meanings:

• "Website" is a separate place on the global Internet network, accessible via
  its unified address (URL) using HTTP, HTTPS or other standardized protocol and
  containing files, programs, text, sound, pictures, images or other materials and
  resources.
• "Venom" Ltd. is a commercial company, with UIC 205389422, with registered office and management address
  in the city of Plovdiv, Trakia district, block 193, entrance B, floor 6, email: info@evolutionwatches.bg.
• www.evolutionwatches.bg is an e-commerce website owned by Venom
  Ltd. and is a virtual information resource on the Internet for the sale of goods from
  distance, which are delivered after their explicit request by the Client.
• "Client" is a natural person over 18 years of age, or a legal entity that is registered
  at Evolution Watches and has agreed to these Terms and Conditions.
• "Customer profile" is a separate part of Evolution Watches, containing information about
  The Customer, provided upon registration and stored by Evolution Watches, as
  Access to the client profile is achieved by entering a username and

  provides automatic data processing.
• "IP Address" is a unique identification number associating a computer or resource to the Client
  on the internet.
• "Commercial messages" are advertising or other communications presenting goods, services or
  the reputation of a person.
• "Malicious actions" are actions that violate internet ethics or cause harm,
  such as sending spam, hacking, sabotage, etc.
• "web page" is a component of a website.

Subject

Evolution Watches provides the Customer with the opportunity to purchase the goods offered in the online store after registration by submitting an order request and paying the relevant sales price, subject to the Customer's strict compliance with these General Terms and Conditions.

Conditions according to the Electronic Commerce Act (E-Commerce Act)

The order placed by the Customer and accepted by "Venom" EOOD through the online platform Evolution Watches is with the force of a distance purchase and sale contract. This contract is concluded by pressing buttons such as "Order", "Buy on credit" or "Quick order" and filling in identification, contact and delivery data. The contract is considered concluded after confirmation of the order and receipt of an email from Evolution Watches with the order details.

Registration

To place valid requests to purchase goods from Evolution Watches, the Customer must:

• To correctly complete the online registration form www.evolutionwatches.bg;
• To provide complete and accurate data and to update it within 7 days in case of change;
• To guarantee the accuracy of the data provided.

If the Customer provides incorrect data or does not update the changes, Evolution Watches may suspend access to his account. After agreeing to the General Terms and Conditions, the Customer is bound by them.

Changes to the Terms and Conditions

Evolution Watches may unilaterally change the General Terms and Conditions in the event of catalog expansion or legislative changes. The customer will be notified via email or a message in their account, and the changes do not affect previous orders.

Publishing information about goods

Evolution Watches published on www.evolutionwatches.bg description, image and selling price of the goods including VAT, as well as information about delivery, payment and the right of withdrawal. The supplier is not responsible for any incorrect data from the manufacturer.

Purchase request

The application is submitted through:

• Selecting a product and clicking "Order", "Buy on credit" or "Quick order";
• Entering delivery and payment data;
• Confirmation via the "Confirm order" button.

The request is related to a payment obligation. If the address or telephone number is incorrect, the request is invalid.

Accepting the request

The request is accepted via email with information about the product, price and delivery, after checking availability and confirmation by phone or email.

Prices

Prices at Evolution Watches are in BGN including VAT and do not include shipping costs unless otherwise stated.

Payment methods

Payment can be:

• Cash on delivery – cash on delivery;
• With credit/debit card;
• On credit – after approval from a bank;
• By bank transfer.
• Refunds are made within 15 days through a reverse transaction on the card or a transfer to a bank account.

Delivery

The goods are delivered to the specified address within 1-3 business days. Orders after 2:00 p.m.
processed the next business day. The customer must notify Evolution Watches within 5 days
in case of delay.

Delivery of the goods

The goods are handed over to the Customer or an authorized person. If the Customer is absent within the delivery period, he bears the costs of re-delivery.

Right of withdrawal

The customer can examine the goods in front of the courier within 15 minutes and return them if they do not meet expectations, bearing the costs of return. A consumer under the Consumer Protection Act can withdraw from the contract within 14 days without reason, returning the goods in an undamaged condition. The refund is made within 15 days.

Warranty periods and complaints

Evolution Watches guarantees conformity of the goods within 2 years from delivery. Complaints are submitted via an electronic form, with the Customer providing documents for the purchase.

Rights and obligations of Evolution Watches

Evolution Watches undertakes to deliver the goods and transfer ownership, and has the right to use cookies and send commercial messages with Customer consent.

Limitation of liability

Evolution Watches does not guarantee uninterrupted access and is not responsible in the event of force majeure or lack of goods in stock.

Client's rights and obligations

The client undertakes to provide accurate data, pay the price and comply with legislation and ethics. He has the right to access and correct his data.

Personal data

"Venom" Ltd. uses personal data only for processing orders and communication, without providing them to third parties, except as required by law.

Termination

The contract is terminated upon deletion of the account or cessation of the activities of Evolution Watches.

Dispute resolution

Disputes are resolved by court order in the city of Plovdiv, if they are not settled by mutual agreement.

Applicable law

The legislation of the Republic of Bulgaria applies.
